Statement on data protection
The sensitive and responsible handling of personal data of all users is extremely important for smudoo. On these grounds, all data protection laws and regulations are followed by smudoo. These data protection laws include principally the Telecommunication Data Protection Act (TDDSG), the Federal Data Protection Act (BDSG), the data protection provisions of the Telecommunication Act (§§ 85 ff. TKG) and the legislative provisions on the EU level.
Personal data
Registration
smudoo sees itself as a social network, and like every network that serves for communication, smudoo is built on the principle that a member as part of his personal profile makes available or supplies to other members particular data or particular information about himself. The basis for this principle is that the information made available in such a profile is accurate. Only under this assumption can a network like smudoo be intelligently used. For this reason, members are requested as early as the time of registration to give at least a minimum amount of information about themselves. If smudoo becomes aware of a false identity, smudoo will attempt to establish the real identity. By accepting the General Conditions for Doing Business, the member declares himself prepared to bear the cost if it should come to finding out his true identity. Costs that may arise include costs for detective agencies, information agencies, network providers, etc. The information that is later made available to other members will obviously be individually defined and administered by each member.
Voluntary data
In addition to the minimum data, as part of registration each member has the opportunity to answer other questions and thus to prepare more information. The member is not required to give these data, but it should be clear to the member that making a contact is more likely if the additional data on one`s person are given, such as data on hobbies or interests. Every member privately decides what data are to be given in his profile.
"Private sphere"
Giving a nickname allows a member to remain anonymous, if this is desired. The anonymisation serves to protect the members, and smudoo expects responsible behaviour with the service "nickname".
Purposefulness
Collecting, saving, processing, and using personal data given at registration will be done by smudoo in line with legal provisions (in particular §§ 3 ff. TDDSG and §§ 28, 29 BDSG).
The purpose of collecting, saving, processing, and using data by smudoo is only for making possible and for maintaining the network made available by smudoo for its users. Every member has the possibility of revising his own data and making them accessible to other members according to user defined conditions.
Use data
We collect and use personal data from you if this is necessary to make possible or to improve the expectations of our Internet offering (use data). These include in particular characteristics to identify you and data on the beginning, ending, and scope of the use of our offer. We create pseudonymous user profiles for the purposes of advertising, market research, and required changes in our Internet offering. You have the right to object to the use of your data. We do not combine the user profiles with data on the owners of the pseudonyms.
Use profile/Use statistics
In order to continually improve the offering from smudoo, such as with new areas or new offers, smudoo will analyze the behaviour of its members in the network and for this purpose will create anonymised use statistics. The evaluation of these use statistics in no cases will involve personal data, meaning that the identity of the member will remain anonymous.
Cookies
Cookies are small text files that are placed either temporarily in the working memory or permanently saved on the hard disk. Anonymous IDs are allocated to members by the use of cookies, but no programs are placed on the member`s computer and no computer viruses are transferred.
smudoo uses meeting cookies for authenticating the member at log-in. The use of cookies serves for easy use of the service by the member and to improve the offerings for members by smudoo.
Every member has the free choice of setting his Internet browser program as to whether cookies are accepted, whether the member is notified about the placement of a cookie, or whether all cookies are refused in general. However, smudoo notifies you that the use of the smudoo service is not possible if cookies are refused.
Server Log
Files
Every time a member calls up a page, the access data used by the Internet browser are automatically saved in protocol files, which are called Server Log Files. The stores of data are regularly backed up by smudoo. If these data security items include protocol files, these are also deleted after a defined time. In the case of the complete deletion of a member profile, the protocol files are also deleted.
Data security
The firewall and other security systems that are put in place by smudoo are updated on a continuing basis are meant to protect as far as possible the members and their profiles from viruses and unauthorized access. smudoo will prosecute under civil law and criminal law every hacker attack that is discovered.
Implementation and maintenance of this data protection statement
smudoo obligates itself to maintain the standard given in this data protection statement and to constantly work in the future to improve data protection in the interests of the members.
Change in the data protection statement
Since the offerings from smudoo can be changed, in the individual case the need for new items on the data protection statement occurs. The same applies for all other changes in the applicable legal regulations that require an adjustment.
